1. What these terms cover
These terms govern your use of orbys-ai.com and any information on it. If you engage Orbys Business OS as a client, a separate signed service agreement governs that relationship and takes precedence over these terms wherever the two differ.
2. Information on this website
We keep this site accurate, including the prices. Prices are in Canadian dollars, exclude HST, and may change — the price that applies to you is the one written into your signed proposal. Nothing on this site is an offer capable of acceptance, and nothing here is legal, financial or professional advice.
3. Booking a demo
Submitting a form places you under no obligation and costs nothing. We will use your details to respond and to follow up about our services. You can ask us to stop at any time and we will.
4. Fees and payment
- The setup fee is payable before implementation work begins.
- Monthly fees are billed in advance on the same day each month.
- All amounts are in Canadian dollars and exclude applicable taxes.
- Annual prepayment, where offered, is non-refundable but transferable within your business.
5. Cancellation
Monthly service is month to month. Either party can end it with 30 days written notice. On termination we export your data to you in a standard format and delete our production copy within 30 days. The setup fee is not refundable once implementation has begun, because the work it pays for has been done.
6. Your data
Your data remains yours at all times. We claim no ownership of it and no right to use it beyond providing the service to you. We do not use it to train models and we do not disclose it to other clients. See our privacy policy for the detail.
7. AI output and your responsibility
This is the clause that matters most, so it is written plainly. Our agents generate drafts, analyses and recommendations using large language models. These systems are extremely capable and they are not infallible.
- By default, every outbound action requires approval by a person at your company. Approving an output means you have taken responsibility for it.
- If you choose to grant an agent autonomy for a given action, you do so knowingly and you define the limits.
- You remain responsible for legal, tax, financial and safety decisions in your business. An agent's output is an input to your judgement, not a substitute for it.
8. What we will not do
We will not configure agents to send unsolicited bulk messages, to deceive the recipient about who they are dealing with, or to do anything that would breach applicable law including Canada's anti-spam legislation. If a requested use case falls into that territory we will decline it.
9. Availability
We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance is announced in advance. Third-party services we depend on — model providers, hosting, integrations — occasionally have outages that are outside our control.
10. Limitation of liability
To the extent permitted by law, our total liability arising out of the service is limited to the fees you paid us in the twelve months preceding the claim. We are not liable for indirect or consequential losses, including lost profits or lost business opportunities.
11. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it. The courts of Ontario have exclusive jurisdiction.
